Welcome to FurSwipe. These Terms of Service govern your use of the FurSwipe website and your purchase of products from FurSwipe (Pty) Ltd, trading as FurSwipe™.

By accessing or using our website, or placing an order with us, you agree to be bound by these Terms of Service. Please read them carefully before using our website or purchasing our products.


1. Use of Website

This website is operated by FurSwipe (Pty) Ltd, trading as FurSwipe™.

By accessing our website, you agree to use it only for lawful purposes and in accordance with these Terms.

You may not use our website:

  • For any unlawful or fraudulent purpose;

  • To interfere with the operation or security of the website;

  • To attempt to gain unauthorised access to our systems;

  • To copy, reproduce or commercially exploit our content without permission; or

  • In any way that could damage FurSwipe, our customers or our service providers.

We reserve the right to restrict or terminate access to our website where reasonably necessary.


2. Eligibility and Customer Information

By placing an order with FurSwipe, you confirm that the information you provide is accurate, complete and current.

You are responsible for ensuring that your contact, billing and delivery information is correct.

If incorrect information results in a failed or delayed delivery, additional delivery charges may apply where permitted by law.


3. Our Products

We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information displayed on our website are accurate.

However, colours and appearances may vary slightly depending on your device or screen settings.

We reserve the right to:

  • Correct errors or inaccuracies;

  • Update product information;

  • Change product specifications where reasonably necessary;

  • Limit quantities available for purchase; and

  • Discontinue products without prior notice.

Any such changes will not affect an order that has already been accepted and paid for, except where permitted or required by law.

Customers are responsible for using products appropriately and safely.

FurSwipe is not responsible for damage caused by misuse, abuse, alteration of a product, failure to follow instructions, or use for a purpose for which the product was not intended, subject always to your rights under applicable South African law.


5. Orders

When you place an order through our website, you are making an offer to purchase the selected products.

An order confirmation does not necessarily mean that FurSwipe has accepted the order.

We reserve the right to refuse or cancel an order where, for example:

  • A product is unavailable;

  • There is an obvious pricing or product description error;

  • We reasonably suspect fraudulent activity;

  • Payment cannot be successfully processed; or

  • We are otherwise unable to fulfil the order.

If we cancel an order after payment has been received, we will arrange an appropriate refund in accordance with applicable law.


6. Prices and Promotions

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

We make reasonable efforts to ensure that prices are accurate. However, obvious errors may occur.

Promotional offers may be subject to specific terms, conditions, availability and time limits.

Unless expressly stated otherwise, promotions cannot be combined with other promotional offers.

FurSwipe reserves the right to end or amend a promotion, subject to applicable law.


7. Payment

Payment must be successfully completed before an order can be processed, unless another payment arrangement has been expressly agreed with FurSwipe.

We may use third-party payment service providers to process payments.

FurSwipe does not intentionally retain complete payment-card information where this is handled directly by our payment service providers.

You agree to provide accurate payment and billing information and confirm that you are authorised to use the payment method provided.


8. Shipping and Delivery

We deliver orders to addresses within our available delivery areas in South Africa.

Delivery times displayed on our website are estimates unless expressly stated otherwise.

Once your order has been dispatched, you may receive tracking information where tracking is available.

Delivery may be affected by circumstances outside our reasonable control, including courier delays, severe weather, public holidays, strikes, incorrect delivery information or other unforeseen events.

Nothing in this section limits any consumer rights relating to delivery under applicable South African law.


9. Returns, Refunds and Cancellations

Our returns, refunds and cancellation procedures are set out in our separate Returns & Refund Policy, which forms part of these Terms.

Our standard voluntary return period is 3 days from the date the order is received, subject to the conditions and exclusions contained in our Returns & Refund Policy.

Customers should review the Returns & Refund Policy before placing an order.

However, the 3-day voluntary return period does not replace or limit any rights a consumer may have under applicable South African law.

Where applicable, consumers retain their rights under the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

For example, qualifying defective goods may be subject to statutory remedies under the CPA, while qualifying electronic transactions may be subject to the ECTA cooling-off provisions. (Government of South Africa)

Nothing in our Terms or Returns & Refund Policy is intended to waive, exclude or unlawfully limit any mandatory consumer right.


10. Intellectual Property

All content appearing on the FurSwipe website, including but not limited to:

  • Logos;

  • Brand names;

  • Product photographs;

  • Graphics;

  • Text;

  • Website design;

  • Product descriptions;

  • Videos; and

  • Other original materials

is owned by or licensed to FurSwipe (Pty) Ltd unless otherwise stated.

You may not reproduce, copy, modify, distribute, sell or commercially exploit our intellectual property without our prior written permission.

FurSwipe™ and associated branding may not be used without our permission.


11. User Reviews and Feedback

If you submit a review, comment, photograph, testimonial, suggestion or other content to FurSwipe, you confirm that you have the right to submit that content.

You grant FurSwipe permission to use, reproduce and display such content for legitimate business and marketing purposes, subject to applicable law.

You must not submit content that:

  • Is unlawful;

  • Is defamatory;

  • Infringes another person's rights;

  • Contains malicious software;

  • Is misleading or fraudulent; or

  • Contains inappropriate or offensive material.

We reserve the right to remove content that violates these requirements.


12. Third-Party Services

Our website may use third-party services, including payment providers, courier companies, Shopify and other technology providers.

These third parties may have their own terms and privacy policies.

FurSwipe is not responsible for the independent policies, services or actions of third-party providers, except where liability cannot lawfully be excluded.

Our online store is hosted and powered using Shopify's ecommerce platform.

Shopify provides the technology that allows us to offer our products and services to you.

Your use of our website remains subject to these Terms, as well as any applicable Shopify terms and policies governing its services.


14. Website Availability

We aim to keep the FurSwipe website available and operating properly, but we cannot guarantee uninterrupted or error-free access.

The website may occasionally be unavailable because of:

  • Maintenance;

  • Updates;

  • Technical issues;

  • Hosting problems;

  • Security incidents; or

  • Circumstances outside our reasonable control.

We may modify, suspend or discontinue parts of the website where reasonably necessary.

We make reasonable efforts to ensure that information on our website is accurate.

However, errors, omissions or inaccuracies may occasionally occur.

Nothing in this section limits rights granted to consumers under applicable law.


16. Limitation of Liability

To the maximum extent permitted by South African law, FurSwipe will not be liable for indirect, incidental or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, these Terms do not exclude or limit any consumer rights, warranties or remedies that cannot legally be excluded under South African law.


17. Events Outside Our Control

FurSwipe will not be responsible for delays or failures caused by circumstances reasonably outside our control.

These may include:

  • Natural disasters;

  • Severe weather;

  • Fire;

  • Flood;

  • Power failures;

  • Internet or telecommunications failures;

  • Strikes;

  • Civil unrest;

  • Government actions;

  • Courier disruptions;

  • Supplier disruptions; or

  • Other unforeseen events beyond our reasonable control.

Where possible, we will take reasonable steps to minimise the effect of such events.


18. Privacy

We collect and process personal information in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Personal information may be used for purposes including:

  • Processing and delivering orders;

  • Processing payments;

  • Providing customer support;

  • Communicating with customers;

  • Improving our website and services; and

  • Other purposes permitted by law.

We take reasonable measures to protect personal information in our possession.

We reserve the right to take appropriate action where prohibited activity occurs.


20. Termination

We may suspend or terminate access to our website where a user materially breaches these Terms or engages in unlawful, fraudulent or abusive conduct.

Termination will not affect rights or obligations that arose before termination.

Any provisions that are intended to survive termination will continue to apply.


21. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising from these Terms will be subject to the jurisdiction of the courts of South Africa, subject to any mandatory consumer rights, jurisdictional rules or dispute-resolution mechanisms that may apply.


22. Consumer Rights

Nothing in these Terms is intended to remove, restrict or waive any rights provided to consumers by applicable South African legislation.

This includes, where applicable, rights under the:

  • Consumer Protection Act 68 of 2008;

  • Electronic Communications and Transactions Act 25 of 2002; and

  • Protection of Personal Information Act 4 of 2013.

Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail.

The CPA expressly recognises consumer protections relating to safe and good-quality goods and an implied warranty of quality. (Government of South Africa)

We may update these Terms from time to time to reflect changes to our business, products, services, legal requirements or website.

The latest version will be published on our website with the applicable Last Updated date.

Your continued use of our website after an updated version has been published constitutes acceptance of the updated Terms, to the extent permitted by law.


24. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the extent necessary to make it lawful and enforceable, where possible.

The remaining provisions will continue to apply.


25. Entire Agreement

These Terms, together with our other published policies, including our Privacy Policy and Returns & Refund Policy, constitute the terms governing your use of the FurSwipe website and purchase of our products, subject to applicable law.
